Welcome to World of Mothers Inc. (“World of Mothers”, “we”, “us”, or “our”). These Terms & Conditions (“Terms”) govern your use of our website saymomshop.com (the “Site”) and any purchases you make from us.
By accessing or using the Site, or by placing an order with us, you agree to be bound by these Terms. If you do not agree, please do not use the Site or purchase our products.
1. Use of the Site
You may use this Site only for lawful purposes and in accordance with these Terms. You agree not to:

Product descriptions, images, colours, sizing information, or specifications are error-free, complete, or perfectly accurate

Products will always be available, in stock, or delivered within any specific timeframe

4. Orders & Payment
By placing an order, you represent that:

You are at least the age of majority in your province/state/region, and

You are legally capable of entering into a binding contract
All orders are subject to acceptance and availability. We may, at our sole discretion, refuse or cancel any order for reasons including but not limited to:

Product unavailability

Suspected fraud or unauthorized/illegal activity

Errors in pricing or product information
If your order is cancelled after payment has been processed, we will issue a refund to your original payment method, subject to the currency and refund terms in Section 5 and Section 7.6 below.
You agree to provide current, complete, and accurate payment and billing information for all purchases made via the Site.
5. Pricing, Taxes & Currency
Prices displayed on the Site are generally shown in the currency indicated at checkout (for example, CAD, USD, EUR, etc.), and are for your convenience.
However, our underlying billing and refund currency is United States Dollars (USD). This means that:

Your payment provider (bank, credit card company, PayPal, etc.) may convert your local currency into USD at the time of purchase.

All refunds are processed in USD back to your original payment method. If you paid in another currency, your payment provider will convert the refunded USD amount back into your local currency.
You acknowledge and agree that:

Exchange rates are set by your bank or payment provider, not by World of Mothers.

Due to currency conversion and possible bank or card fees, the amount you receive in your local currency on refund may differ from the original amount you paid in your local currency.

We are not responsible for any currency conversion differences, foreign transaction fees, or related charges.
Applicable sales taxes, duties, and other fees (where required by law) will be added at checkout based on the shipping destination and relevant tax rules.
We reserve the right to change prices at any time without notice.
6. Shipping & Delivery
We ship to the locations listed at checkout. Any shipping times provided are estimates only and are not guaranteed.

We are not responsible for delays caused by carriers, customs, weather, or other factors beyond our control.

Risk of loss passes to you when the product is handed over to the carrier.

If a package is marked as delivered by the carrier but you have not received it, you agree to work with the carrier to investigate the issue.
7. Returns & Refunds Policy
We want you to be satisfied with your purchase. Our 30-day return policy means you have 30 days after receiving your item to request a return, subject to the conditions below, including any applicable restocking fees, currency rules, and return shipping responsibilities.
7.1 Eligibility for Returns
To be eligible for a return:

Your item must be in the same condition that you received it

Unworn or unused, with tags, and in its original packaging

You must provide the receipt or proof of purchase

Instructions on how and where to send your package
Return shipping is the customer’s responsibility. This means:

You are responsible for arranging and paying for the return shipping label and any associated costs, unless otherwise required by law or explicitly stated by us in writing.

We do not typically provide prepaid return shipping labels for change-of-mind or non-defective returns.
Items sent back to us without first requesting a return will not be accepted.

7.2 Damages & Issues
Please inspect your order upon receipt and contact us immediately if:

The item is defective

The item is damaged, or
-
You received the wrong item
This allows us to review the issue and, where appropriate, arrange a replacement, refund, or suitable remedy.
In many cases, because we act as a distributor of third-party manufactured products, resolution may involve working with the manufacturer’s warranty or policies. We may request photos, videos, or additional information to assess the claim and coordinate with the manufacturer or supplier.
Where the product is found to be defective, damaged on arrival, or incorrect due to our error, we may, at our discretion and where required by law, cover or reimburse reasonable return shipping costs and waive any restocking fee.
7.3 Exceptions / Non-Returnable Items
Certain types of items cannot be returned, including but not limited to:

Perishable goods (such as food, flowers, or plants)

Custom or made-to-order products (such as personalized items)

Personal care items (such as certain beauty or hygiene products)

Hazardous materials, flammable liquids, or gases

Sale items and gift cards are non-returnable and non-refundable unless required by law.
7.4 Exchanges
The fastest way to get what you want is to:

Return the item you have; and

Once the return is accepted, place a new order for the replacement item.
7.5 European Union 14-Day Cooling-Off Period
If your merchandise is being shipped into the European Union, you have the right to cancel or return your order within 14 days of receiving it, for any reason and without justification.
As above, the item must be:

In the same condition you received it

Unworn or unused, with tags

In its original packaging
You will also need the receipt or proof of purchase.
Return shipping responsibility and any applicable restocking fees will apply in accordance with these Terms, except where EU consumer protection laws require otherwise.
7.6 Refunds, Currency & Restocking Fees
Once we receive and inspect your return, we’ll notify you whether your refund is approved.
If approved:

Refunds are issued only to your original payment method, and

Refunds are processed in USD (United States Dollars).

If you paid in a different currency, your bank or payment provider will convert the USD refund into your local currency at its own exchange rate.

Currency Conversion Notice:

Due to fluctuating exchange rates and possible bank/card fees, the amount you receive in your local currency may be more or less than the amount you originally paid in your local currency.

World of Mothers is not responsible for any differences caused by exchange rate changes, international transaction fees, or other charges imposed by your bank or payment provider.

Restocking Fee:

For most approved returns that are not due to our error or a confirmed defect/damage, a restocking fee of ten percent (10%) of the product’s purchase price (before taxes and shipping) will be deducted from your refund.

This restocking fee helps cover inspection, handling, and processing costs.

We may waive or reduce the restocking fee where required by law or in limited circumstances at our sole discretion (e.g., confirmed defective item, wrong item sent by us).

Return Shipping Costs:

Unless otherwise required by law or explicitly stated by us in writing, return shipping costs are your responsibility and are not refundable.

We will process the refund on our end within 10 business days of approving the return. Your bank or credit card company may take additional time to process and post the refund.

8. Distributor Status, Third-Party Manufacturers & Warranties
Many of the products available through World of Mothers are manufactured, produced, or supplied by third-party companies that are not owned or controlled by us. Important (but standard) clarification: World of Mothers acts primarily as a distributor and reseller of products manufactured by third-party suppliers and manufacturers. We do not design, formulate, or manufacture most of the products sold on our Site. Any technical specifications, safety information, certifications, and performance claims about the products are based on information provided by the respective manufacturers or suppliers.
Accordingly, you acknowledge and agree that:

Product quality, performance, safety, ingredients, formulations, and durability are primarily the responsibility of the respective manufacturer or supplier.

Any manufacturer warranties, safety instructions, or usage guidelines are provided by third parties, and your rights may be governed by their terms.

We may, at our discretion, help facilitate communication between you and a manufacturer or supplier, but:

We are not the guarantor of any manufacturer’s warranty; and

We do not assume liability for manufacturing defects, product design, or improper labeling by third-party manufacturers, except where such liability cannot be excluded under applicable law.

Always read all product labels, instructions, warnings, and safety guidelines before using any product, especially items intended for:

Because we act as a distributor/reseller and are not the manufacturer of most products, we cannot and do not assume responsibility for latent defects, product design issues, or manufacturing decisions made by third-party manufacturers, except where such liability cannot be excluded by law.
